In Scottish education law a young person is a child aged 16 or over, and they have the same rights as parents and carers under the Education (Additional Support for Learning) (Scotland) Act 2004/2009. If a young person does not have the capacity to make their own decisions, parents may continue to make decisions for them. For more information about this refer to the Adults with Incapacity (Scotland) Act 2000
